Acceptable Usage Policy

A1WebSystems provides World Wide Web page hosting. The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers whilst at the same time satisfying our legal and ethical responsibilities. A1WebSystems reserves the right to suspend or cancel a customer's access to any or all services provided by A1WebSystems when A1WebSystems decides that the account has breached the Acceptable Usage Policy. No credits will be issued for outages incurred through service disablement resulting from violation of this Acceptable Usage Policy.

SERVER USE
A1WebSystems reserves the right to refuse service and /or access to its servers to anyone.

A1WebSystems does not allow any of the following content to be stored on its servers or its servers to be used for the following purposes:

Illegal Material
This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State, Provincial or Local regulation. This also includes material used to spread hate against any race, religion, person, place, government etc
Adult Material
Due to special system and network requirements of adult oriented sites, pornography and sex-related merchandising are prohibited. This includes sites that may infer sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet. Links to such materials are also prohibited.
Warez
Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
Background running processes and Cron Jobs
Includes background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation.
SPAM
Spamming, or the sending of mass unsolicited email, from or through a A1WebSystems server or using an email address that is maintained on a A1WebSystems machine is STRICTLY prohibited.

BANDWIDTH AND SERVER USAGE POLICY

In rare cases A1WebSystems may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, A1WebSystems reserves the right to impose the High Resource User Policy for the consideration of all customers.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. A1WebSystems may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available A1WebSystems reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby A1WebSystems continues hosting the website for an additional fee. In addition, customers availing of hosting on VNSL servers may please note that monthly data traffic in excess of six times the purchased hosting space is billable on a per Gb basis at rates prevailing at time of such higher resource utilization.

Payment Policies

All accounts are set up on a prepay basis. Although A1WebSystems the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers are required to pay renewal fees one week before the end of their prepay period unless closure notification has already been given.

In situations where no payment is received on or before the end of the term, A1WebSystems will immediately suspend all facilities provided to the customer until the outstanding charge is processed successfully. In addition. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made.

All payment should be made either in Indian Rupees, United States Dollars, British Pounds or Euros.

CANCELLATION AND REFUNDS
A1WebSystems reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes A1WebSystems's Terms of Service a refund will not be issued in the event of a cancellation.

If not entirely happy with the service provided by A1WebSystems customers may cancel their order within 30 days from order date without reason. Any monthly payment made will be returned within 30 days of cancellation. Setup fees are non-refundable.

Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund unless the service is cancelled by A1WebSystems or in circumstances where A1WebSystems is in breach.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold A1WebSystems harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against A1WebSystems, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless A1WebSystems against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with A1WebSystems's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from A1WebSystems's server.

Changes to Hosting Policies

A1WebSystems reserves the right to revise its policies at any time. All changes will appear on this page and we will use commercially reasonable efforts to inform you of any substantial changes.
